System crimes and Luigi Ferrajoli's global constitutionalism
responses to international anarchy and the crisis of global governance in the 21st century

The contemporary international order faces unprecedented challenges, such as the wars in Ukraine and Gaza, and the Venezuelan crisis. These conflicts, categorized by Luigi Ferrajoli as “system crimes,” expose the fragility of international law and the ineffectiveness of the UN in maintaining peace. This article critically analyzes international anarchy, linking it to Ferrajoli's proposals for an “Earth Federation” and global “legal garantism.” It explores the viability and obstacles to implementing these ideas amidst growing nationalisms, unilateralism, and unregulated economic interests. It concludes by highlighting the urgent need to reform global governance to mitigate systemic catastrophes and ensure humanity's survival.
